OFFICIAL RULES:

By entering the Contest, you agree to be bound by the terms of these Contest Rules. By submitting your Entry (defined below) to the Contest, you are deemed to have reviewed, read and accepted these Official Rules

General: Your Entry (defined below) into the Contest is subject to the Contest Rules, and all other guidelines, terms and conditions stated elsewhere on LowFares.com and all applicable laws, ordinances and regulations, including but not limited to all laws respecting intellectual property, trademarks, copyrights, rights of privacy, pornography and defamation. By entering the Contest, you accept and agree to be bound by the Contest Rules.  LowFares.com shall be the administrator of the Contest and shall sometimes be referred to as the “Administrator”.

How to Enter: To enter, you must “Like” LowFares.com on Facebook. Then email the photo you wish to submit to fbsupport@lowfares.com along with a one sentence description of the photo (your photo and description are together referred to as your “Entry”). No more than one (1) Entry per person will be allowed.

Entries: All Entries submitted must be original works and photos must be in .jpg format.  Digitally enhanced images, manipulated or composites of multiple images must be derivations of the entrant’s original photos for which the entrant is the copyright holder. We will accept photos taken by you or photos of you. However since photos of you are usually taken by someone else, you MUST have their consent to use the picture that you submit. In addition, where a photo includes images of other people, you MUST have their consent (or, where such persons are under the age of majority, of their parent or legal guardian) to use the photo before you submit it.  As such, you are required to comply with all U.S. and international copyright laws, any and all laws regarding intellectual property, privacy and rights of personality and you will indemnify LowFares.com and its affiliates for any violations in connection with the image(s) and descriptions submitted to the Contest. Furthermore, entrants agree to indemnify and hold harmless LowFares.com, its affiliates, subsidiaries, parents, directors, offices, and employees, against any and all claims, judgments, damages, liabilities, penalties and fines of any kind, stemming from any discovery that the submitted photo (and/or the related description) violates any applicable laws. By submitting your images and descriptions, you grant LowFares.com and its affiliates the right to use, publish, reproduce, modify and disseminate any of your images in print and/or on our website or other websites, online publications, email newsletters or in any other manner we desire.  You also waive any claims of ownership or copyright protection in or to your Entry.

Entry must be in the theme of the Contest to be considered. We reserve the right to reject any Entries which we, in our sole and absolute discretion, deem offensive, in violation of law or unsuitable in any other manner.  All Entries become the exclusive property of LowFares.com and will not be returned. Entries (i) may not have been previously published or won any other prize/award, (ii) must be the exclusive original work of the entrant, true and verifiable, (iii) must be in keeping with LowFares.com’s image, (iv) may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by LowFares.com in its sole discretion, (v) must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by LowFares.com in its sole discretion, (vi) may not violate or encourage others to violate any applicable law, statute, ordinance or regulation, (vii) may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party right, (vii) may not contain commercial/corporate advertising, including but not limited to corporate logos, brand names and slogans, other than those relating to LowFares.com, and (ix) may not include any virus, worm, corrupt file, Trojan horse or other forms of corruptive code or content that may harm or compromise the Site and/or the proper conduct of the Contest. By submitting an Entry, each entrant represents that: (a) he/she has the unrestricted right to submit the Entry; (b) all persons whose name or likeness appear in the Entry have unconditionally consented in writing to their appearance in the Entry and unconditionally granted to the Entrant in writing the right to submit the Entry subject to these Official Rules, a copy of which consent and grant will be furnished to LowFares.com upon request; and (c) the Entry does not infringe upon any third party’s proprietary or other right. By entering, each entrant grants to LowFares.com and its designees a worldwide, non-exclusive, sub-licensable (through multiple tiers), transferable, fully paid-up, royalty-free, perpetual, irrevocable right to use, not use, reproduce, distribute (through multiple tiers), create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale and import the Entry in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, without further approval by or payment to entrant.

Contest Period: The Contest begins at 12:00:00 a.m. (Pacific Time) on June 1, 2010 and ends at 11:59:59 p.m. (Pacific Time) on June 30, 2010.  Entries submitted before or after the contest period will not be eligible for consideration.

Prizes: Two prizes will be awarded with each prize being a $250 (USD) Visa gift card.  All prizes will be awarded (assuming sufficient number of eligible entries).  Limit: One prize per family or household.  LowFares.com is responsible only for prize delivery it is not responsible for prize utility, quality or otherwise.  Taxes and fees, if any, as well as any costs incurred in claiming or using the prize are the sole responsibility of winners.  Winners shall indemnify, defend and hold harmless LowFares.com, its affiliates, subsidiaries, parents, directors, offices, and employees from and against any liabilities arising from or regarding taxes owed on prizes.  Prizes must be accepted as awarded; no cash substitutes.  Administrator reserves the right to substitute a prize of equal or greater value.

Judging: All eligible Entries shall be judged by an independent panel of judges selected by LowFares.com, based on the following criteria: 70% creativity and originality, and 30% uniqueness of location.  All decisions of the judges will be final and binding.  Winners will be chosen within 30 days after the end of the Contest Period.  LowFares.com will notify the winners via email.  Winners will not be publicly announced.  To obtain a list of winners of the Contest, send a self-addressed, stamped envelope by August 30, 2010 to: LowFares.com, ATTN: Summer Travel Memory Photo Contest Winners List, 515 S. Flower St., Suite 4400, Los Angeles, CA 90071.  The winners list will only be sent after selection and verification of the winners.

Verification of Winners and Delivery of Prizes: Prize winners may be required to sign an affidavit of eligibility and liability release and return the completed form together with (for US winners) a properly completed IRS Form W-9.  Prize may be awarded to alternate winner if affidavit/release is not returned within 14 days after mailing to winner, prize notification or prize is returned as undeliverable or entrant does not respond to prize notification e-mail within 7 days after the date of the e-mail, or if a selected winner otherwise does not comply with the Contest Rules.  Winners agree to the use by LowFares.com of their name, address, likeness, images and descriptions submitted and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law.

Eligibility: In order to participate in the Contest, you must be a legal resident of Canada, the United States, the District of Columbia, or the U.S. territories and possessions.  Entrants must be 18 years of age or older as of June 1, 2010 to enter.  Employees, officers and directors of LowFares.com and its affiliates and their immediate families and those living in the same household are not eligible to enter or win (“immediate family” is defined as parents, siblings, children or spouse). Winning a prize is contingent on fulfilling all requirements set forth herein.  LowFares.com reserves the right to verify the eligibility of winners.

General Restrictions: This Contest is void outside the United States and Canada and where prohibited or restricted by law and subject to all applicable federal, state/provincial and local laws and regulations.  To the extent permitted by applicable law, this Contest will be governed by the internal laws of the State of California and any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States.

For entrants residing in the Province of Québec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Administrator is not responsible for: (a) late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due or misdirected Entries, e-mails or other communications; errors, omissions, interruptions, deletions, (b) defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; data corruption, theft, destruction, unauthorized access to or alteration of entry materials; loss or otherwise; or (c) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant’s e-mail account to receive e-mail messages.  The use of automated software or computer programs to register or to enter this Contest is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified.  Administrator disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest if any virus, bug, technical failure, unauthorized human intervention or other cause outside of Administrator’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest.  In the event of any such cancellation, termination or suspension, a notice will be posted and winners will be selected by the judges based on the criteria set forth above from among all eligible, non-suspect entries received prior to such time.  Administrator reserves the right, at its sole discretion, to disqualify any entrant (and all of her/his Contest entries) from this Contest or any other promotion conducted now or in the future by Administrator or any of its affiliates if she/he tampers with the entry process or if her/his fraud or misconduct affects the integrity of this Contest.  Administrator reserves the right to correct clerical or typographical errors in promotional materials.  By participating in this Contest, each entrant accepts the conditions stated in the Official Rules, agrees to be bound by the decisions of the judges and warrants that she/he is eligible to participate in this Contest. By accepting prize, winner agrees to release Administrator and its directors, employees, officers and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity.

Warning. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this Contest is a violation of criminal and civil laws.  Should such an attempt be made, sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law.
