LowFares Launches Facebook Photo Contest

How to Enter:
Step 1: Become a fan of LowFares.com here!! (if you already are a fan then skip this step)
Step 2: Add your favorite travel photo to our fan page using the ‘Add Photos’ link in the fan photos section, and load the pictures to the ‘LowFares.com Facebook Photo Contest’ folder.
Step 3: Get all your friends to write witty comments on your photo!!
The Contest Details:
We are basically looking for the best travel photo as determined by our judges. We want you to impress us!! Exotic locales are a plus, as are photos of you holding up a sign that reads: ‘LowFares.com Rocks!!’ in front of the Pyramids at Giza! The more you impress us, or make us laugh, the better your shot at winning. We will accept photos taken by you or photos of you. However since photos of you are usually taken by someone else, you MUST have their consent to use the picture that you submit. No purchase is necessary to enter or win the Contest.
One more thing… We will only accept photos submitted from your PC and not ones from existing facebook albums. If the photo you want to submit is already in one of your albums, no problem! Just load that same photo to the contest album directly from your PC.
In entering the Contest you subject yourself to both the Contest Rules and Legal Terms and Conditions. By submitting images to the Contest, you are deemed to have reviewed, read and accepted both.

The Contest Period:
The Contest runs from March 1, 2009 at 12:00:00 AM PT until 11:59:59 PM PT on March 31st, so don’t wait! If you don’t have a good picture, then use LowFares.com to find some amazing last minute deals…..but don’t forget your camera!
Contest Rules:
1. No more than 1 photo entry per person will be allowed. The photo you wish to submit must be uploaded to the LowFares.com Facebook Photo Contest album on the LowFares Facebook fan page.
2. Photo must be in the theme of the contest to be considered.
3. All work submitted must be an original work. We will accept photos taken by you or photos of you. However since photos of you are usually taken by someone else, you MUST have their consent to use the picture that you submit. As such, you are required to comply with all U.S. and international copyright laws, any and all laws regarding intellectual property and you will indemnify LowFares.com and its affiliates for any violations in connection with the image(s) submitted.
4. No purchase necessary to enter the LowFares.com Facebook Photo Contest.
5. We reserve the right to reject any photos which we, in our sole and absolute discretion, deem offensive, violative of law or unsuitable in any other manner. Examples of the following types of photos we will reject include he following:
- Pornographic or nude images
- Images promoting illegal drug use
- Images depicting crimes of any nature
- LowFares.com is not required to provide any explanation for the rejection.
6. The Photos submitted shall be judged by an independent panel of judges selected by LowFares.com based on the following criteria: 60% creativity and originality, 20% exotic location, 15% Facebook user comments and 5% use of LowFares.com in the picture. All decisions of the judges of the Contest will be final and binding.
7. There will be a total of three Visa gift card prizes:
- 1st place wins $150
- 2nd place wins $75
- 3rd place wins $25
8. The LowFares.com Facebook Photo Contest start and end date to submit photos will be stated on the LowFares.com Facebook fan page. The winners will be announced within 30 days after the end of the contest. All winners will be notified by email or Facebook messages.
9. Entrants must be 18 years of age or older to enter the Contest. Entrants must also be legal residents of the United States, the District of Columbia, Puerto Rico or the U.S. territories and possessions. Employees of Lowfares.com and its affiliates, and their immediate family members, are not eligible. No professional photographers will be eligible.
10. In entering the contest you subject yourself to both the Contest Rules and Legal Terms and Conditions. By submitting images to the Contest, you are deemed to have reviewed, read and accepted both.
Legal Terms and Conditions:
General: Your entry into the LowFares.com Facebook Photo Contest (the “Contest”) is subject to the Contest Rules, the following Legal Terms and Conditions, and all other guidelines, terms and conditions stated elsewhere on this site and all applicable laws, ordinances and regulations, including but not limited to all laws respecting intellectual property, trademarks, copyrights, rights of privacy, pornography and defamation. By entering the Contest, you accept and agree to be bound by the Contest Rules and these Legal Terms and Conditions. LowFares.com shall be the administrator of the Contest and shall sometimes be referred to as the “Administrator”.
Submissions of Photographs:
All work submitted must be original work. Digitally enhanced images, manipulated or composites of multiple images must be derivations of the entrant’s original photos for which the entrant is the copyright holder. We will accept photos taken by you or photos of you. However since photos of you are usually taken by someone else, you MUST have their consent to use the picture that you submit. As such, you are required to comply with all U.S. and international copyright laws, any and all laws regarding intellectual property and you will indemnify LowFares.com and its affiliates for any violations in connection with the image(s) submitted to the Contest. Furthermore, entrants agree to indemnify and hold harmless LowFares.com, its affiliates, subsidiaries, parents, directors, offices, and employees, against any and all claims, judgments, damages, liabilities, penalties and fines of any kind, stemming from any discovery that the submitted photo violates any and all applicable laws. By submitting your images, you grant LowFares.com and it affiliates the right to use, publish or disseminate any of your images in print and/or on our website, online publications, email newsletters or in any other manner we desire. You also waive any claims of ownership or copyright protection with the photos you submit.
Contest Period: The LowFares.com Facebook Photo Contest begins at 12:00:00 a.m. (Pacific Time) on March 1, 2009 and ends at 11:59:59 p.m. (Pacific Time) on March 31, 2009. Photos submitted before or after the contest period will not be eligible for consideration.
Prizes: There are three prize levels:
• 1st Place: $150
• 2nd Place: $75
• 3rd Place: $25
Prizes will be awarded in the form of a Visa gift card. All prizes will be awarded (assuming sufficient number of eligible entries). Limit: One prize per family or household. Lowfares.com is responsible only for prize delivery it is not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of winners. Winners shall indemnify, defend and hold harmless LowFares.com, its affiliates, subsidiaries, parents, directors, offices, and employees from and against any liabilities arising from or regarding taxes owed on prizes.
Judging: The photos submitted shall be judged by the LowFares.com Facebook Photo Contest team, an independent panel of judges selected by LowFares.com, based on the following criteria: 60% creativity and originality, 20% exotic location, 15% comments and 5% use of LowFares.com in the picture. All decisions of the LowFares.com Facebook Photo Contest judges will be final and binding. Winners will be chosen within 30 days after the end of the Contest Period. Lowfares.com will notify the winners via email or Facebook message. Winners will not be publicly announced. To obtain a list of winners of the Contest, send a self-addressed, stamped envelope by June 30, 2009 to: Lowfares.com, ATTN: Facebook Photo Contest Winners List, 515 S. Flower St., Suite 4400, Los Angeles, CA 90071. The winners list will only be sent after selection and verification of the winners.
Verification of Winners and Delivery of Prizes: Prize winners will be required to sign an affidavit of eligibility and liability release and return the completed form together with a properly completed IRS Form W-9. Prize may be awarded to alternate winner if affidavit/release is not returned within 14 days after mailing to winner or if prize notification or prize is returned as undeliverable or if prize notification e-mail is undeliverable, if entrant does not respond to prize notification e-mail within 7 days after the date of the e-mail. Winners agree to the use by Lowfares.com of their name, address, likeness, images submitted and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law.
Eligibility: In order to participate in the Contest, you must be a legal resident of the United States, the District of Columbia, Puerto Rico or the U.S. territories and possessions. All federal, state, and local laws and regulations apply. Void where prohibited or restricted, including the States of Florida and New York. Must be 18 years of age or older as of March 1, 2009 to enter. Employees, officers and directors of lowfares.com and its affiliates and their immediate families and those living in the same household are not eligible to enter or win. No professional photographers will be eligible. Winning a prize is contingent on fulfilling all requirements set forth herein. Lowfares.com reserves the right to verify the eligibility of winners.
Copyright Notice: Lowfares.com respects the intellectual property of others, and we ask our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also in our sole discretion limit access to the site and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. If we remove or disable access in response to such a notice, we will make a good-faith attempt to contact the owner or administrator of the affected site or content so that they may make a counter notification. Limitation of Liability: UNDER NO CIRCUMSTANCES SHALL LOWFARES.COM OR ITS AFFILIATES BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, COST OF COVER, OR LOST DATA THAT ARISE IN WHOLE OR IN PART FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE SERVICES OR FUNCTIONS OF THE SITE OR ARISING OUT OF YOUR ACCESS TO, OR INABILITY TO ACCESS, THE SITE OR YOUR RELIANCE UPON, THE SITE OR THE SERVICES, CONTENT OR MATERIALS IN, OR FUNCTIONS OF, THE SITE, PROVISION OF, OR FAILURE TO PROVIDE SERVICES, OR INFORMATION, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY (INCLUDING NEGLIGENCE). General Restrictions: This Contest is void outside the United States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States. Administrator is not responsible for: (a) late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due or misdirected entries, e-mails or other communications; errors, omissions, interruptions, deletions, (b) defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; data corruption, theft, destruction, unauthorized access to or alteration of entry materials; loss or otherwise; or (c) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to register or to enter this Contest is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified. Administrator disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest if any virus, bug, technical failure, unauthorized human intervention or other cause outside of Administrator’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest. In the event of any such cancellation, termination or suspension, a notice will be posted and a random drawing will be held from among all eligible, non-suspect entries received prior to such time. Administrator reserves the right, at its sole discretion, to disqualify any entrant (and all of her/his Contest entries) from this Contest or any other promotion conducted now or in the future by Administrator or any of its affiliates if she/he tampers with the entry process or if her/his fraud or misconduct affects the integrity of this Contest. Administrator reserves the right to correct clerical or typographical errors in promotional materials. By participating in this Contest, each entrant accepts the conditions stated in the Contest Rules and these Legal Terms and Conditions, agrees to be bound by the decisions of the judges and warrants that she/he is eligible to participate in this Contest. By accepting prize, winner agrees to release Administrator and its directors, employees, officers and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity.
Warning. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law.
